These Terms & Conditions (“Terms”) apply to all sales, deliveries, and will-call pickups from Turf USA (the “Company”) to wholesale customers (“Customer”). By placing an order, signing a Customer Application/Credit Application, or accepting delivery or pickup, Customer agrees to these Terms.

Quotes are valid only for the time stated (or 24 hours if not stated) and are subject to inventory availability and pricing changes. Orders may be changed or canceled only with Company’s written approval. Special orders and cut/pre-cut items are non-cancelable and non-returnable.
Prices exclude sales/use tax and freight unless stated otherwise. Customer is responsible for all taxes and governmental charges. Company may charge reasonable fees for re-delivery, storage, waiting time, or special handling when caused by site conditions, Customer requests, or Customer unavailability.
Unless otherwise agreed in writing, payment is due at time of purchase. If Company extends credit, invoices are due Net 30 from invoice date (or as stated). Past-due amounts may accrue a late charge of 1.5% per month (or the maximum allowed by law, if less) plus collection costs. Company may place accounts on hold, require prepayment, or modify credit terms at any time.
Customer must inspect all product immediately upon receipt or pickup. Any shortage, damage, or quality issue must be reported in writing within 24 hours of receipt and before any cutting, installation, or use. No claims are accepted after installation, cutting, or alteration.
Returns (stock items only):
Returns are accepted within 5 days of receipt with a 10% restocking fee, less any freight costs. Returned items must be unused, uninstalled, and in original packaging and condition. Turf removed from original packaging or altered is not eligible for return. No returns on special orders or cut/pre-cut turf. Returns require written return authorization and instructions from Company.
Approved delivery locations are limited to: (a) curbside, (b) paved driveway (concrete/asphalt), or (c) concrete/asphalt paved parking lot/paved yard area with easy access. Company will NOT drive on or cross grass, dirt, sand, mulch, loose gravel/shell, decorative surfaces, or into backyards/side yards, tight/confined areas, or areas with overhead hazards. Drivers are not authorized to make exceptions. If the site does not meet policy, Company will unload at the nearest safe approved location.
Customer must provide safe access and a suitable unloading area, clear obstacles/vehicles, and keep people/pets away. Customer is responsible for delays or re‑delivery caused by lack of access or unsafe conditions.
If Customer requests, directs, or permits delivery or unloading on or across any non-approved surface or unsafe area, Customer assumes all risk of damage to land, driveways, pavers, landscaping, irrigation, structures, curbs, and improvements arising from access or unloading.
Customer releases and agrees to indemnify and hold harmless Company from claims, losses, and damages arising from site conditions or Customer directions, except to the extent caused by Company’s gross negligence or intentional misconduct.
A. Customer vehicles (pickups, SUVs, light vehicles):
Customer is solely responsible for vehicle suitability (payload, bed size, weight limits), selecting loading orientation, and securing or tying down all materials. Any assistance by Company personnel is a courtesy only. Customer assumes all risk of damage to vehicles, property, persons, or product during and after loading, except to the extent caused by Company’s gross negligence or intentional misconduct.
B. Commercial landscape trucks, flatbeds, or trailers loaded by Company:
Company will load product onto Customer’s commercial vehicle using forklifts and place it on the vehicle in a reasonably safe manner. Company is responsible for damage directly caused by Company’s negligence during forklift loading on Company premises. Customer remains solely responsible for load securement, straps or chains, compliance with laws and regulations, and all transit risk once the vehicle departs.
For deliveries, risk of loss transfers to Customer upon unloading at the approved delivery location. For will-call pickups, risk of loss transfers when the product is placed on Customer’s vehicle or otherwise made available for pickup and Customer takes possession or control (whichever occurs first).
Synthetic turf and related products may vary by dye lot, batch, lighting conditions, and installation direction. Product dimensions and weights may have industry-standard tolerances. Customer is responsible for confirming style, color, roll sizes, and quantities before cutting or installing.
Any applicable written warranty is provided separately and controls over any inconsistent statements. EXCEPT AS EXPRESSLY PROVIDED IN A WRITTEN WARRANTY, PRODUCTS ARE PROVIDED “AS IS” AND COMPANY DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPANY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, LOST BUSINESS, OR LABOR/INSTALLATION COSTS). COMPANY’S TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT PAID FOR THE SPECIFIC PRODUCTS GIVING RISE TO THE CLAIM.
These Terms are governed by Florida law. Any dispute must be brought in state or federal courts located in Palm Beach County, Florida, and the parties consent to that venue. The prevailing party is entitled to reasonable attorneys’ fees and costs.
Company may update these Terms from time to time by posting an updated version at the URL above. If any provision is unenforceable, the remainder remains in effect. Failure to enforce a provision is not a waiver. Customer may not assign its rights without Company’s written consent.
